Legal proceedings issued by PWS Distributors against Moben in November 2010 for the alleged infringement of the design and trademark rights in the Metris Wave Curve may have been brought to a premature close with the news that the Homeform Group called in the administrators on 6 July. PWS claim that the design of Moben's Curved Wave product was not only a copy of the Metris Wave Curve but also carried a name that was too close to their name which is a registered trademark.
Heavy promotion of the Moben product featured set photography which strongly resembled Metris, down to the use of the same brand and configuration of extractors.
PWS engaged the services of intellectual property specialist Lupton Fawcett and retained Henry Carr QC in anticipation of a trial in 2011. Although Moben had refused to acknowledge copying, displays and advertising were withdrawn in the run-up to Christmas last year.
